ARTICLE 1 - PURPOSE
These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Le Domaine de Rose and any person making a reservation, whether it is made:
- direct (phone, email)
- or via an online reservation platform, such as Booking.com
All reservations imply full acceptance of these terms and conditions, without exception.
ARTICLE 2 - DESCRIPTION OF SERVICES
Le Domaine de Rose offers the rental of a furnished cottage including:
- rooms
- Living room and dining room
- equipped kitchen
- Outdoor spaces and garden
- swimming pool (seasonal and weather permitting)
- spa (depending on season, maintenance, and upkeep)
- Access to domain facilities
The estate also houses animals (miniature horses, ponies, chickens, sheep).
The equipment and services are described on the official communication materials and may change without prior notice.
ARTICLE 3 - DIRECT BOOKING
The reservation is considered firm and definitive after :
- acceptance of these terms and conditions
- payment of a deposit equal to 20% of the total cost of the stay
The balance must be paid before arrival as agreed.
In the event of non-payment of the balance within the time limit, Le Domaine de Rose reserves the right to cancel the reservation without refund of the deposit.
ARTICLE 4 - RESERVATION VIA PLATFORM
When the booking is made through Booking.com:
- The pricing conditions, payment terms, and cancellation conditions are those validated on the platform at the time of booking.
- These conditions apply to commercial aspects.
These General Terms and Conditions apply to :
- Use of the cottage
- Internal rules
- The security deposit and its deductions
- Tenant's liability
- Use of facilities (including pool, spa)
- Adherence to safety rules
- Prohibitions and occupancy conditions
ARTICLE 5 - PRICES
Prices are expressed in euros.
They include:
- the provision of the cottage
- Access to facilities by season
A cleaning fee of €160 must be added.
An additional cleaning fee may be charged in case of abnormal condition of the accommodation (excessive dirt, unremoved waste, deterioration requiring specific intervention).
The corresponding fees may be deducted from the deposit, with supporting documents provided if necessary.
ARTICLE 6 – CAUTION
A deposit of 900 € is requested before arrival or upon key handover.
It notably covers:
- damage
- Non-compliance with regulations
- excessive cleaning
- Equipment deterioration
- Non-compliance with pool/spa safety regulations
- Fees related to late departures or exceptional services
The security deposit may be partially or fully retained to cover justified damages or expenses. Reimbursement will be made after inspection of the premises, within a reasonable timeframe.
ARTICLE 7 - CANCELLATION CONDITIONS (DIRECT BOOKINGS)
- Cancellation up to 14 days before arrival: full refund
- Cancellation between 13 days and the day of arrival: 100% of the total cost of the stay is due
- Early departure: no refund
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to accommodation services.
ARTICLE 8 – ARRIVAL AND DEPARTURE
Arrival : between 5 PM and 10 PM.
- Any unannounced delay or arrival outside of this timeframe may result in partial or full cancellation of the reservation or additional charges.
- The owners reserve the right to refuse access to the accommodation in case of non-compliance with schedules or lack of prior communication.
Departure before 10 a.m.
- Any departure outside of scheduled hours may incur additional charges., even if a late departure was permitted.
- The fees may cover:
- Staff overtime
- Additional cleaning service
- Bias related to the arrival of other occupants
- The owners reserve the right to deduct these fees from the security deposit if necessary.
Special agreements :
- Any changes to the schedule must be confirmed in writing or by email.
- Confirmation of a late departure does not guarantee that there will be no billing.
ARTICLE 9 – USE OF THE SWIMMING POOL AND SPA
The pool and spa:
- are unsupervised
- are accessible according to season and technical conditions
- are used under the sole responsibility of the occupants
Obligations
- Constant and active surveillance of children
- Strict adherence to safety devices
- Mandatory shower before use
- No food in the water
- Prohibition of dangerous behavior in the water
Failure to comply with safety and usage instructions releases the tenant from exclusive liability.
The Domaine de Rose cannot be held responsible for an accident resulting from:
- Of recklessness
- From a lack of supervision
- Disrespect for posted rules
ARTICLE 10 – DOMAIN ANIMALS
The Rose Estate is home to animals.
It is strictly forbidden:
- to feed animals without permission
- to enter the enclosures without an escort
- to provoke or scare animals
Children must be supervised at all times near animals.
Any injury resulting from inappropriate behavior or failure to follow instructions shall be the sole responsibility of the occupants.
ARTICLE 11 – PROHIBITIONS
Are prohibited:
- smoking indoors
- unauthorized parties and gatherings
- excessive noise nuisances
- Pets (unless otherwise agreed with riders)
ARTICLE 12 – LIABILITY
The lessee is responsible for :
- damage caused during the stay
- child supervision
- respect for neighbors
- proper use of equipment
Le Domaine de Rose is not responsible for:
- theft or loss of personal items
- from an accident related to improper use of the facilities
- failure to comply with safety instructions
ARTICLE 13 – GUARANTEE
The tenant must be covered by liability insurance including a vacation clause.
A certificate may be required before taking possession of the premises.
ARTICLE 14 – TERMINATION OF CONTRACT AND EVICTION
Any serious breach (endangering, damage, disturbances, failure to supervise children, disregard for pool/spa safety) may result in:
- immediate expulsion
- Partial or total retention of the security deposit
- no refund of remaining stay
ARTICLE 15 – NUMBER OF OCCUPANTS
The maximum number of people allowed is the number indicated at the time of booking.
Any additional undeclared person may result in:
- immediate cancellation of the stay
- the security deposit retention
- or additional billing
ARTICLE 16 – FORCE MAJEURE
Le Domaine de Rose shall not be held liable for any inability to fulfill its obligations due to a force majeure event (natural disaster, fire, major technical failure, power outage beyond its control, etc.).
In these cases, the amounts paid will be reimbursed without additional compensation.
ARTICLE 17 – ACCESS TO HOUSING
The owners reserve the right to access the property in case of:
- emergency
- technical problems
- of suspicion of serious breach of these T&Cs
After informing occupants in advance, except in an absolute emergency.
ARTICLE 18 – LOST PROPERTY
Lost items can be returned to the customer upon request, at their expense.
If not requested within 3 months, they may be retained or destroyed.
ARTICLE 19 – DATA PROTECTION
The personal data collected is necessary for managing reservations and legal obligations.
They are processed in accordance with the RGPD.
Travelers have the right to access, rectify, and delete their information upon simple written request.
ARTICLE 20 – VIDEO SURVEILLANCE
Certain outdoor areas of the property may be placed under video surveillance for security purposes, in accordance with current French regulations.
The devices do not concern interior private spaces.
ARTICLE 21 – MEDIATION AND DISPUTES
In case of dispute, an amicable solution will be sought as a priority.
In accordance with the provisions of the Consumer Code, the customer may freely use the services of a consumer ombudsman.
Failing an amicable agreement, French courts shall have exclusive jurisdiction.
ARTICLE 22 – GOVERNING LAW
These terms and conditions are governed by French law.
ARTICLE 23 – ACCEPTANCE OF TERMS
All bookings imply full acceptance of these terms and conditions.
The client acknowledges having read and understood this before confirming their reservation.
