ARTICLE 1 - PURPOSE

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Le Domaine de Rose and any person making a reservation, whether it has been made:

ARTICLE 2 - DESCRIPTION OF SERVICES

Le Domaine de Rose offers furnished cottage rentals including:

The estate also houses animals (miniature horses, ponies, chickens, sheep).

The equipment and services are described on the official communication materials and may change without prior notice.


ARTICLE 3 - DIRECT BOOKING

The reservation is considered firm and definitive after :

The balance must be paid before arrival as agreed.

In the event of non-payment of the balance within the specified timeframe, Le Domaine de Rose reserves the right to cancel the booking without any refund of the deposit.


ARTICLE 4 - BOOKING VIA THE PLATFORM

ARTICLE 5 - PRICES

The prices are expressed in euros.

They include:

A cleaning fee of €160 is to be added.

An additional cleaning charge may apply in the event of the property being left in an abnormal condition (excessive dirt, waste not removed, damage requiring specific intervention).

The corresponding costs may be deducted from the security deposit, with supporting documents provided if necessary.


ARTICLE 6 – CAUTION

A deposit of 900 € is requested before arrival or upon key handover.

It notably covers:

The deposit may be partially or totally retained to cover justified damages or costs. The refund will be made after inspection of the premises, within a reasonable timeframe.


ARTICLE 7 – CANCELLATION TERMS (DIRECT BOOKINGS)

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to accommodation services.


ARTICLE 8 – ARRIVAL AND DEPARTURE

Arrival between 5 p.m. and 10 p.m.

Departure before 10 am.

ARTICLE 9 – USE OF THE SWIMMING POOL AND SPA 

The swimming pool and the spa

Obligations

Failure to comply with safety and usage instructions is the sole responsibility of the tenant. 

Le Domaine de Rose shall not be held responsible for an accident resulting from: 


ARTICLE 10 – ESTATE ANIMALS

The Domaine de Rose is home to animals.

It is strictly forbidden:

Children must be supervised at all times in close proximity to animals.

Any injury resulting from inappropriate behaviour or failure to follow instructions will be the sole responsibility of the occupants. 


ARTICLE 11 – PROHIBITIONS

Le Domaine de Rose declines all responsibility in the event of:


ARTICLE 13 – ASSURANCE

The tenant must be covered by third-party liability insurance including a holiday letting clause.

A certificate may be requested before entering the premises.


ARTICLE 14 – TERMINATION OF CONTRACT AND EVICTION

Any serious breach (endangerment, damage, nuisance, failure to supervise children, failure to observe swimming pool/spa safety regulations) may result in:


ARTICLE 15 – NUMBER OF OCCUPANTS

The maximum number of people allowed is the number indicated at the time of booking.

Any additional undeclared person may result in:


ARTICLE 16 – FORCE MAJEURE

Le Domaine de Rose shall not be held liable for any inability to fulfil its obligations due to an event of force majeure (natural disaster, fire, major technical failure, power outage beyond its control, etc.).

In these cases, the sums paid will be reimbursed without further compensation.


ARTICLE 17 – HOUSING ACCESS

Landlords reserve the right to access the property in the event of:

After informing the occupants in advance, except in an absolute emergency.


ARTICLE 18 – LOST PROPERTY

Forgotten items can be returned to the client upon request, at their expense.

If they are not requested within 3 months, they may be retained or destroyed.


ARTICLE 19 – DATA PROTECTION

Personal data collected is necessary for the management of reservations and for legal obligations.

They are processed in accordance with the RGPD.

Travellers have the right to access, rectify and delete their data upon simple written request.


ARTICLE 20 – VIDEO SURVEILLANCE

Certain outdoor areas of the estate may be subject to video surveillance for security purposes, in accordance with current French regulations.

The devices do not concern internal private areas. 


ARTICLE 21 – MEDIATION AND DISPUTES

In the event of a dispute, an amicable solution will be sought as a priority.

In accordance with the provisions of the Consumer Code, the customer may use a consumer mediator free of charge.

In the absence of an amicable agreement, the French courts shall have exclusive jurisdiction.


ARTICLE 22 – GOVERNING LAW

These GCS are governed by French law.


ARTICLE 23 – ACCEPTANCE OF TERMS

All bookings imply full acceptance of these GCS.

The client acknowledges having read these terms and conditions before confirming their reservation.
